Salman Khan gets relief from court in 2002 hit-and-run case

In a major relief for Bollywood actor Salman Khan, a Mumbai Sessions court has ordered a fresh trial in the 2002 hit-and-run case and the hearing is from December 23.

Salman-Khan-arrestThis would mean that all the witnesses and evidence will be re-examined. Prosecution opposed the move calling it as a delaying tactic.

The 47-year-old actor had pleaded last month for the fresh trial the lower court did not give him an opportunity to cross-examine the witnesses.

The actor was charged under 304(2) with culpable homicide not amounting to murder which attracts a jail term of up to 10 years.

Salman stated in his plea that the earlier evidence adduced at trial be discarded as the charges are more serious now.

In a setback move, a Mumbai Sessions court had framed the charges in June against Salman. Earlier he was tried for rash and negligent driving which had a lesser jail term prescribed for two-year.

Salman had allegedly run upon people sleeping on a pavement outside a bakery with his Land Cruiser in suburban Bandra in September 2002.

One person was killed and four others got injured in the accident. Only one witness out of the total 39 witnesses turned up in court and the actor was charged in July.

With fresh trial being ordered a re-evaluation of evidence and testimonies will be done by the court in the fast track mode.
