Trump's Mass Deportation Plans: Military Deployment on Day 1?

Take his promise to support mass deportations using the U.S. military extremely seriously. The specifics of Trump’s intended force deployment are unknown to us. Run jail facilities? People to transport? Make raids? Everything is unknown.

Observers anticipate that he will act on Day 1, possibly within hours of his inauguration on January 20. Trump would issue a proclamation granting him the authority to use the military in the United States by using, for example, the Alien Enemies Act of 1798, the Insurrection Act, or some other outdated legislation.

That doesn’t mean that the following day, Trump, holding a Sharpie, will witness troops advancing into Chicago.

According to Goitein, Trump’s use of the military has a greater influence than the undocumented people. People will be scrambling to try to figure out what Trump’s plans are from Day 1 or shortly thereafter.

Trump might deploy the military without invoking the Insurrection Act

The question, according to Goitein, is whether troops are merely supporting civilian authorities or if they go beyond the bounds of actually performing core law enforcement functions themselves.”

If Trump goes too far in that direction, there may be a challenge. It will be difficult, if not impossible, to stop Trump from trying a military move beforehand. The courts will have to decide whether or not he can do it.
