Modi Govt Amends 1978 Act Over 5 Facility Types Freed from Police Licensing

Delhi Chief Minister Rekha Gupta on Saturday praised the central government’s decision to amend the Delhi Police Act, 1978, removing Section 28, which previously empowered the police to issue licenses and no-objection certificates (NOCs) for establishments such as swimming pools, hotels, motels, eating houses, and auditoriums.

The announcement came following an executive order from the Lieutenant Governor, with the change being implemented under the leadership of Prime Minister Narendra Modi. Gupta described the move as a “clear example of the benefits of a double engine government,” referring to the alignment between the central and Delhi administrations.

Section 28 of Delhi Police Act Removed to Streamline Licensing

Previously, Section 28 of the Delhi Police Act gave the police authority to regulate and approve licenses for various commercial and recreational facilities. However, this provision often led to bureaucratic delays and overlapping responsibilities between law enforcement and civic agencies.

Now, with the section officially removed, the responsibility for issuing licenses will rest solely with the respective government departments or municipal bodies overseeing those facilities. This change is expected to reduce administrative friction and allow the police to focus on core duties such as maintaining law and order.

Rekha Gupta Applauds Reform as a Boost to Governance

Reacting to the development, CM Rekha Gupta stated, Rekha Gupta says, “I am very happy that the people of Delhi are getting the benefit of a double engine government… Today, on the orders of the LG, the government led by Prime Minister Modi took a decision regarding the Delhi Police Act 1978, whose Section 28 earlier governed the Police to control the to issuing of licenses, no objection certificates or permissions for swimming pools, eating houses, hotels, motels, auditoriums which has now been removed.

“Now, only the government or the body under which that facility comes will complete the process of granting licenses. The job of the police is to run the administration, to provide security, now the police will be able to do their work without any hindrance… I thank Prime Minister Modi, the Lieutenant Governor… This is the power of the vote of the people of Delhi…”.
